Ireland Regulator Investigates Meta Over Facebook, Instagram «Dark Patterns»

Ireland’s media regulator, Coimisiún na Meán, is investigating Meta over Facebook and Instagram «dark patterns» that may violate EU Digital Services Act rules on user choice and interface design. The probes examine if users can easily opt out of personalized content feeds. Meta faces potential fines up to 6% of global turnover if breaches are found.

Ireland’s media regulator, Coimisiún na Meán, has launched two investigations into Meta concerning potential breaches of the EU’s Digital Services Act (DSA) on Facebook and Instagram. The probes focus on «dark patterns» in interface design and user choice, specifically whether users can easily switch to non-profiled content feeds.

Under EU law, platforms must provide a clear option for users to view content not personalized by their behavior or interests. The investigation will assess if Meta’s designs manipulate users away from these non-profiled options. Digital Services Commissioner John Evans stated platforms must not prevent users from exercising their rights or manipulate them away from empowered choices, especially regarding recommender systems that can push harmful content, particularly to younger users.

If breaches are found, Meta could face fines up to 6% of its global turnover. Coimisiún na Meán has increased its DSA enforcement, conducting other investigations and collaborating with the European Commission on broader probes involving platforms like TikTok, X, and Shein.
