Dylan Magee, 33, of Churchfield Green in Cork, was sentenced to 13 years in jail with the final year suspended after being convicted of manslaughter due to diminished responsibility in the death of Matthew Healy. Healy, an 88-year-old retired farmer from Berrings, Co Cork, was admitted to the Mercy University Hospital on January 13, 2023, after a fall.
Magee, a father of three, was admitted to the same hospital on January 19, 2023, suffering hallucinations and claiming to have taken 120 benzodiazepine tablets in the week prior. He punched Healy more than 20 times in an unprovoked attack, later telling gardaí he thought Healy had eaten his son. Healy died just over a week after being admitted.
At trial, Magee pleaded not guilty to murder but guilty to manslaughter by reason of diminished responsibility. The jury found him guilty of manslaughter after three days of evidence in December. Healy's daughter, Claire, urged Ms Justice Siobhán Lankford to impose the maximum sentence.
Ms Justice Lankford acknowledged the psychiatric evidence and the jury's verdict, stating that a sentence at the highest end of the scale would have been warranted without Magee's distorted mental state. She noted Healy's vulnerability and Magee's strength, adding that placing Magee in a general ward was unwise.
