New Bill in Dáil Seeks «No Wait Cards» for Chronic Illness Toilet Access

A new bill in the Dáil, championed by Maria Crowe and TD Mark Wall, proposes «No Wait Cards» for people with chronic illnesses, granting legal access to staff toilets. This aims to improve dignity and independence for thousands, addressing a widespread issue often misunderstood by the public and businesses alike.

A new bill before the Dáil, the Equal Status (Access to Toilet Facilities) Bill 2026, aims to provide better toilet access for people with chronic illnesses in Ireland. Introduced by Labour TD Mark Wall, the bill seeks to legally establish «No Wait Cards,» allowing individuals with certain medical conditions to use staff toilets in businesses if public facilities are unavailable.

Maria Crowe, who suffers from painful bladder syndrome, has championed this legislation. She recounted an incident where she was denied staff toilet access during a flare-up, forcing her to urinate in a retail car park. Crowe highlights that many people with similar conditions restrict their outings due to unpredictable toilet needs, impacting their dignity and independence.

Deputy Wall, who has Crohn’s disease, understands the issue personally. He notes that many businesses closed customer toilets during the pandemic and haven't reopened them, despite having staff facilities. While organizations like Crohn’s Ireland offer «no wait» cards, these lack legal standing. The proposed bill would provide this legal recognition, potentially issued via GPs or the HSE.

The bill addresses business concerns by exempting them from liability under section 3 of the Occupiers’ Liability Act 1995 for card users. It also proposes that businesses must accept the card only when three staff members are present. Dr. Fadi Salameh, Director of Gynaecology at the Rotunda Hospital, supports the bill, emphasizing that nearly 40% of women experience bladder symptoms, a condition often misunderstood and silently endured.
