Former High Court judge George Birmingham, the Independent Examiner of Security Legislation, has released his first annual report identifying serious gaps in Ireland’s security laws. He highlighted weaknesses in three key pieces of legislation covering communication interception, surveillance, and data retention.

Birmingham specifically recommended a clear legal basis for intercepting and accessing modern digital communications, including messages on apps like WhatsApp, Telegram, and Snapchat. He also called for legal clarity for security agencies to access encrypted communications and clearer rules for surveillance authorization, especially in urgent cases.

While these recommendations could restrict civil liberties, Birmingham proposed safeguards: authorization decisions for intercepts and trackers should be made by courts or senior Garda independent of the investigation. He also suggested imposing time limits on these authorizations. These measures are a response to the challenges posed by technology proliferation among potential threats to state security, including «lone wolf» attacks.
