Ireland Faces «Significant Concern» from Islamist Terrorism, Outdated Security Laws

George Birmingham, Ireland's Independent Examiner of Security Legislation, warns that Islamist terrorism and other threats pose «significant concern.» He states current laws are outdated, lacking provisions for modern digital communication interception and restricting access to crucial mobile data, thereby weakening investigations.

George Birmingham, Independent Examiner of Security Legislation and former High Court judge, stated that Islamist terrorism, «lone wolf» attacks, and «hostile state actors» are significant concerns for Ireland. He also highlighted growing threats from extreme rightwing and leftwing terrorism. Birmingham noted that Ireland's current security legislation is weak and outdated, hindering investigative agencies.

In his first annual report, covering April to December last year, Birmingham, who was appointed in 2023, criticized the lack of legal provisions for intercepting messages on platforms like WhatsApp, Telegram, and Snapchat. He also pointed out that EU restrictions prevent Gardaí from accessing mobile phone data older than 12 months, severely weakening investigations into terrorism and other serious crimes. He cited the 2012 murder of Elaine O’Hara, solved using historical data, as an example of what is now legally inaccessible.

Birmingham's report also criticized the 2009 Criminal Justice (Surveillance) Act for predating modern digital communications and not covering IMSI catchers. Furthermore, the 1993 Interception of Postal Packets and Telecommunications Messages (Regulation) Act only applies to An Post, not modern courier services, creating a significant legislative gap.
