Solicitor Challenges New €520 Flat Fee Criminal Legal Aid Model in High Court

Solicitor John Quinn is challenging a new €520 flat-fee criminal legal aid model in the High Court. He argues the system, effective this week, breaches his right to earn a living and is unjust. The case, deemed of public interest, will return on Tuesday.

Solicitor John Quinn of John M Quinn & Co Solicitor has launched a High Court challenge against a new criminal legal aid payment model for the District Court, which came into effect this week. The new model introduces a flat, one-off legal aid fee of €520 per case, regardless of the number of court appearances required. This replaces the previous system, which based payments on the number of appearances.

Quinn is seeking an order to quash the statutory instrument underpinning these regulations, suing the office of the Minister for Justice, with the Law Society of Ireland as a notice party. On Thursday, Judge Anthony Barr granted permission for a judicial review challenge, noting the case's considerable public interest and its relevance to solicitors and the criminal justice system. The judge emphasized the need for a swift determination.

Quinn argues the new regulations breach his constitutionally protected right to earn a living by providing a single fee for potentially multiple offenses and appearances, and by delaying or potentially eliminating payment until a final order is made. He claims the regulations are «arbitrary, capricious, and unjust» and incompatible with the Criminal Justice (Legal Aid) Act 1962, which provides for legal aid certificates per single offense. Quinn is also seeking an interim stay on the regulations. The case will return on Tuesday.
