Solicitors Protest New Flat Fee Legal Aid System, Warn of «Exodus»

Solicitors are protesting a new flat fee of €520 for criminal legal aid, replacing a per-appearance payment system. Up to 60 solicitors walked out of Dublin District Court, warning of an «exodus.» Critics cite a lack of engagement from Minister for Justice Jim O’Callaghan and fear the changes will worsen court efficiency.

Solicitors are protesting a new flat fee rate for criminal legal aid, warning of an «exodus» from the system. Under the new model, solicitors will receive a flat fee of €520 per accused, replacing the old system where they were paid €239.38 for the first appearance and €59.86 for subsequent hearings.

Yesterday, up to 60 solicitors walked out of Dublin District Court in protest, and some in Cork reportedly offered resignations from the legal aid panel. Gary Mulchrone, President of the Mayo Solicitors' Bar Association, stated on RTÉ's Morning Ireland that the system was introduced «without any real meaningful engagement,» leading to upset and disheartened professionals. He criticized Minister for Justice Jim O’Callaghan for lacking a practical understanding of district court operations and for underinvestment in probation, restorative justice, and mental health diversion programs.

Mulchrone believes the profession has been «denigrated» due to the lack of engagement with the Law Society. Sinn Féin Spokesperson on Justice Matt Carthy echoed concerns about the lack of engagement, fearing the minister's approach might worsen district court efficiency rather than improve it.
