Ukrainian defense companies F-Drones (via Ukrainian Defense Drones Tech Corporation) and General Cherry Corp are competing in the Pentagon's $1.1 billion Drone Dominance Program, but face stringent US protectionist conditions, Defense Express reports. These conditions include forming a US legal entity and partially disclosing technical documentation.

US defense procurement mandates that contractors be US legal entities registered with the US Defense Counterintelligence and Security Agency (DCSA) as defense manufacturers. They must also demonstrate non-use of prohibited Chinese components, meet cybersecurity requirements, and satisfy classified-information access standards.

Foreign ownership thresholds significantly impact approval. A 100%-foreign-owned entity faces multi-year approval timelines and is unlikely to receive DCSA approval for classified contracts. Foreign ownership below 50% triggers a Security Control Agreement (SCA), requiring a US citizen leader, barring foreigners from classified information, and taking months for registration. Only foreign ownership below 5% avoids these additional procedures.

For Ukrainian drone makers, this means US-citizen executives may gain contract signing rights and correspondence with the US Department of Defense. Verifying "no Chinese components" necessitates partial technical documentation disclosure. Production must be relocated or duplicated in the US, creating American jobs. Significant lobbying, often through partnership with a large US prime contractor, is also essential, mirroring Norway's Kongsberg-Raytheon model for the Naval Strike Missile.
